SEC files criminal complaint against Exmix together with the executive for operating digital asset dealer business without a license, and issues an investor alert on platform blocking effective 2 May 2026

Mitihoon – Bangkok, 2 April March 2026 – The Securities and Exchange Commission (SEC) has filed a criminal complaint against Exmix Co., Ltd. (Exmix) and Mr. Chatpon Sakrucharat with the Economic Crime Suppression Division (ECD). The complaint concerns Exmix’s operation of a digital asset dealer business without obtaining the required license, which constitutes a violation of Section 26 and is subject to penalties under Section 66 of the Emergency Decree on Digital Asset Businesses B.E. 2561 (2018) (Emergency Decree). In addition, Mr. Chatpon, as a responsible director in charge of the operations of Exmix, is subject to penalties under Section 94 of the Emergency Decree.

The SEC found that, during the period commencing on 20 September 2021, Exmix, as the operator of the websites https://www.exmix.co and https://wallet.exmix.io/, provided services or held itself out to the public as available to provide services with respect to the trading or exchange of digital assets for Exmix’s own account in the normal course of business outside the digital asset exchange. In addition, Exmix solicited and promoted the use of its services through the aforementioned websites via social media channels in the Thai language.

Such Exmix’s actions are deemed to be the operation of a digital asset dealer business under Section 3 of the Emergency Decree. However, Exmix carried out such activities without obtaining the required licenses, thereby violating Section 26 and being subject to penalties under Section 66 of the Emergency Decree. In this regard, the offense committed by Exmix is considered to have resulted from the instructions or actions of Mr. Chatpon,
the director of Exmix. Accordingly, Mr. Chatpon is subject to penalties under Section 94 of the Emergency Decree.

The SEC has therefore filed a criminal complaint with the ECD against Exmix and Mr. Chatpon for consideration of further legal action.

Following the criminal complaint filed by the SEC, the criminal enforcement process will proceed with an investigation by the inquiry official, prosecution by the public prosecutor, and adjudication by the court of justice, respectively. In this regard, the SEC will monitor the progress of the legal proceedings and cooperate fully with relevant agencies to support legal enforcement under the Emergency Decree after the criminal complaint has been filed.

In addition, the SEC has submitted information regarding the Exmix platform to the Ministry of Digital Economy and Society (MDES) for the purpose of blocking access to the platform. This action is in accordance with the Royal Decree on Measures for Preventing and Suppressing Technology‑Related Crimes (No. 2) B.E. 2568 (2025), which authorizes the MDES to order the blocking of unlicensed digital asset trading platforms to protect investors and prevent the use of unlicensed digital asset trading platforms for money laundering activities. As a result, public access to the Exmix platform will be disabled starting from 2 May 2026.

The SEC urges the public and investors to exercise caution when using services from unlicensed digital asset businesses, as they will not be protected under the law and may be exposed to risks of fraud and scams as well as money laundering activities. The public and investors can verify the list of licensed business operators on the SEC’s website at www.sec.or.th and via the SEC Check First application.
